      契约式大学生管理模式体现了依法治校和以学生为本的管理理念。这一模式在理论上需要进一步明确高校与大学生的教育契约法律关系, 进而区分契约关系中的行政契约和民事契约属性, 区别运用不同的契约形式, 重视大学生管理中的非契约因素; 在实践层面要营造运行环境, 科学制定契约, 完善相应机制, 防范契约失灵。

      T he cont ractual management model embo dies the university management by law and student??oriented management co ncept . T his model, in theo ry, needs a further clear ident ificat ion of the leg al relations of educatio n cont ract betw een college and student s, thus making distinct ion be tw een the pr opert ies o f administ rat iv e co nt ract s and civil lease and the dif ference betw een different cont ractual forms, at taching importance to the non??cont ractual factors in the management o f univ ersity students in, creat ing an oper at ing env ir onment in a pract ical level, formulat ing scient ific cont ract and improving the corresponding mechanisms to prevent failur e of the cont ract .??
